Terms & Conditions

1. About RSM Tree Services

RSM Tree Services is a trading name of RSM Service Group Limited, company number 16283913, registered in England and Wales. Contact: info@rsmtreeservices.co.uk and 07842 066319.

2. Scope

These terms apply to domestic and commercial tree surgery, pruning, removal, stump grinding, hedge, vegetation, equipment and related work supplied by RSM Tree Services. Specific written quotation, purchase order, contract or invoice terms take precedence where they expressly differ.

3. Quotations and acceptance

Formal quotations are normally valid for 30 days unless stated otherwise. Guide prices and estimates are not binding formal quotations. The accepted quotation sets out the final scope and price. A contract is formed when the quotation is accepted or work is otherwise agreed.

Variations and additional work must be agreed before or during the works and may alter the price. Hidden conditions that could not reasonably have been identified during quotation may require a revised scope or price, which will be communicated.

4. Consumer cancellation rights

Where a domestic consumer contract is made at distance or off-premises and statutory cancellation rights apply, the consumer may have a 14-day cancellation right. This does not apply in every circumstance.

If you expressly ask us to begin work during that period, you may have to pay a proportionate amount for work properly carried out before cancellation. Where legally permitted, the cancellation right may end once the service has been fully performed following your prior express request and acknowledgement. Nothing in these terms removes statutory consumer rights.

5. Deposits and payment

A deposit may be required when the team arrives on site and before domestic work begins. Unless agreed in writing, the remaining domestic balance is due immediately on completion. Different payment terms in an accepted quotation or invoice take precedence.

Commercial quotations, purchase orders, contracts or invoices may specify their own payment terms. Where legally appropriate, overdue commercial sums may be subject to reasonable recovery costs or interest.

6. Customer cancellation

If you need to cancel or rearrange booked work, please give at least 48 hours' notice. Where at least 48 hours' notice is provided, no cancellation charge will normally apply.

If less than 48 hours' notice is provided, RSM Tree Services reserves the right to charge a reasonable cancellation fee limited to actual losses and costs reasonably incurred. This may include committed labour, hired plant or equipment, transport, specialist subcontractor costs and other costs that cannot reasonably be recovered or avoided. Any charge will be proportionate, will not exceed the loss actually suffered, and we will take reasonable steps to reduce losses.

7. Postponement and cancellation by RSM

We may postpone, suspend or stop work where reasonably necessary because of unsafe weather, high winds, storms, unsafe access, equipment failure, illness, emergency work, protected wildlife or nesting birds, Tree Preservation Orders, conservation-area restrictions, planning or local-authority restrictions, unsafe site conditions or other circumstances outside reasonable control. We will rearrange work reasonably where practical. Safety takes priority and these terms are not intended to exclude responsibility for matters within our control.

8. Access, authority and site information

You must provide accurate information about the site, property, boundaries, access and known hazards, and confirm that you have authority to instruct the work. You are responsible for arranging permission from neighbours or third parties where required. Parking and access for vehicles, chippers, stump grinders or MEWPs should be available where required by the quotation.

9. Permissions and protected wildlife

You should tell us about Tree Preservation Orders, conservation areas, planning or local-authority restrictions and protected wildlife or nesting birds. Work may need to be postponed or changed where permissions or wildlife considerations apply.

10. Underground services and tree condition

You should identify known drains, cables, pipes, irrigation, underground structures and other services. Tree condition may include hidden defects that cannot reasonably be identified before work. These matters may affect method, scope, timing or price.

11. Working methods and disturbance

Working methods and safety zones will be considered for the agreed work. Lawns, gardens, driveways, paving and surrounding areas may experience reasonable and unavoidable disturbance. We will take reasonable care, but pre-existing damage or defects and limitations inherent in the agreed work are not our responsibility.

12. Stump grinding and roots

Stump grinding and root removal are limited to the scope stated in the quotation. Stump grinding does not claim to remove the complete root system, and regrowth or remaining roots may occur unless expressly included.

13. Arisings, timber and logs

The quotation should state what is removed, left or otherwise dealt with. Branches, woodchip, timber and logs are handled as specified in the quotation. Timber is not automatically left or removed, and waste is not automatically removed unless specified.

14. Delays and completion

Completion timing may be affected by weather, access, permissions, hidden conditions, equipment and events outside reasonable control. Work is complete when the agreed scope has been carried out, subject to any stated follow-up or agreed arrangements.

15. Complaints

Please raise concerns promptly with info@rsmtreeservices.co.uk so we can understand and address them.

16. Liability

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, statutory consumer rights or any liability that cannot legally be excluded. Any other limitation applies only to the extent permitted by law.

17. Website content and external links

Website text and imagery belong to or are used by RSM Tree Services and should not be copied without permission. External links are provided for convenience and are subject to the linked provider's own terms.

18. Governing law and other provisions

These terms are governed by the law of England and Wales. Courts of England and Wales have jurisdiction, subject to any mandatory consumer rights. If a provision is unenforceable, the remaining provisions continue. We may update these terms by publishing a revised version.
